Antonio Sempere, current acting president of the Social Chamber of the Supreme Court, explains to Economist & Jurist that “these nine years in which I have been part of the Chamber have helped me to learn about its weaknesses and strengths. It is a cohesive Chamber with a very important personnel deficit , but at the same time with the desire to continue being what the Constitution and the LOPJ want from us in the workplace."
At the same time, he highlights that “ our Room has a double purpose . The first affects people more directly , which is what is called doing justice and resolving the dispute. That looks good in a collective dismissal or in a retirement, among other matters. But then there is another task related to the Fax Lists unifying role of doctrine that we perform . Faced with the different opinions that come to us from the higher courts of justice, it is up to the Supreme Court to unify criteria. It is dramatic that this unification of criteria takes time, so we are now resolving issues that came to that Chamber three years ago. This is not acceptable from any point of view. In good times it took between nine and 12 months, which has been a reasonable response time.”
The problem is that “ we are now fewer magistrates and the cases do not stop increasing, which generates this delay. Now, while the problem of the blockade of the CGPJ is being solved that allows the vacancies in this Social Chamber to be filled, we have devised, so to speak, an alternative plan that has already been operational since September 1. "
“The last presidencies before mine of María Luisa Segoviano and Rosa Virolés already began a path that now ends. When we notice that an issue is very relevant, we give it priority because we are protected by an agreement of our Government Room published in the BOE and that allows that issue to have priority over others.”
